The French Ordinance of Marine of 1681 entailed the creation of national maritime laws with common principles that overcame the legal traditions of that time. The Ordinance does not regulate the passage contract, but the transportation of people does not go unnoticed all through its articles, sometimes being mentioned expressly and other times with rules that can be inferred from the context. This concept and its relation with the crew and officers are analyzed, as well as the assumption of the death of the passenger on board the ship and their rights and obligations in the case of wreckage and jettison. Special attention is given to the situation of the hired workers (engagés) that were taken on vessels to repopulate the French islands and to work there.
