Every obligation arising from a contract is composed of a so-called “real” object and an “ideal” object, the latter of which being relevant when the issue of non compliance is at stake and when its effects are to be determined. The non compliance problem can be summed up as follows: has the debtor adopted the appropriate behaviour and is the behaviour he finally adopted the one both parties had initially agreed upon? The debtor does not only oblige himself to give or to do something. He must also perform his obligation in such a way that actively promotes compliance, i.e. take concrete measures in order to overcome hurdles or obstacles which could possibly interfere with a dutiful fulfillment of the obligation, no matter how foreseeable such obstacles could be. Non compliance is an objective fact that identifies itself with any deviation by the debtor from the path he must follow to perform his obligations under the contract. Non compliance implies no subjective assessment whatsoever and is as such the key to the remedies which are available to the creditor, and which he can more or less freely choose.
