The absence of a specific regulation, both domestically and internationally, of the right of personal portrayal as an independent personality right, especially for children and adolescences, has caused serious problems facing the punishment of harmful behaviors this right of personality, for not having a special laws, but only with generic rules derived from the few existing constitutional and civil rights, has hampered, in fact, the determination of key elements to punish such conducts. This situation that has been reviewed by the effort of recent case law and practice in the construction of the independent appearance of this law, an issue that has been reflected in the latest laws and Codes published in Latin America regarding the comprehensive protection of infancy and adolescence.
