Resumen

Considering all important social transformations, especially those that happened after II World War, contemporary times show us many State crises in which Law takes a primary role trying to answer to all situations and conflicts regarding the rights and duties of citizens. The arise ofDemocratic States brought back the "active citizenship" concept andpeople started claiming to the jurisdiction for their rights, which are incorporated in contemporary Constitutions as fundamental rights andprinciples. We can highlight among them the affirmation ofrights and contents which are hard to determine, as theprinciple ofthe human being dignity, for example, which became the main base ofthe constitutional rules, and has its correct normative strength and, at the same time, works as a basic principle and informs all actions ofthe instituted powers, making possible their necessary con-cretization. From this background, when citizens start claimingfor their rights to the Judiciary Power, as their resource to guarantee their rights, constitutional jurisdiction is considered as a coordinator of citizens' wishes and it takes an attitude, which results in a question about its role: ifit is an offense to the theory ofthe Powers Separation.
