Abstract
FUENZALIDA BASCUNAN, Sergio. The jurisprudence of the inter-american court of human rights on the right to property, liberal or republican conception?. Estudios constitucionales [online]. 2020, vol.18, n.1, pp.259-308. ISSN 0718-5200. http://dx.doi.org/10.4067/S0718-52002020000100259.
The work reviews the jurisprudence of the Inter-American Court of Human Rights in relation to Article 21 of the American Convention, identifying the content and scope to the protection conferred on private property, in its different modalities and aspects, in order to recognize liberal elements or republicans in sentences, and the reception of different forms of domain. The liberal or republican conceptions of the property, which serve to justify in general terms the inhibition or, on the contrary, the intervention of the State in the use and distribution of the goods, are present in the inter-American jurisprudence without a clear preference for none of them.
Keywords : private property; liberalism; republicanism; human rights; jurisprudence; Inter-American Court of Human Rights.
