The author's objective in this paper is to present an overview of the Transfer of Possession, its concept and basic features, critically cross-check it with the reception it has in recent legal texts, especially in Latin American Civil Codes, and draw some conclusions that may serve to understand its peculiarities, and confronted with the situation of the heirs and their possession of the inheritance. In this regard, it considers both a comparative law and chilean law examination.
