The author describes and analyzes recent jurisprudence of the Supreme Court of Justice that addresses the problem of reluctance (or fraud by omission), manifested as an infringement of the duty of information and in good faith that assists an agent regarding his principal, resolving the case using the art. 1465 of the Chilean Civil Code, the rules of the agency contract and other legal provisions.
