The objective of this work is to delimit the concept, function and content of the set of rules, principles and provisions known as Prison law. To do this, once the context and methodological framework have been established, its terminological evolution will be addressed, highlighting its connection with Administrative law, with the discussion of the purpose of the penalty and with the reception of international post-war legislation. The theme of its function will be developed from the problem related to the determination of its location in the legal system, both at a general level and in criminal law, highlighting how essential the recognition of rights and material guarantees are to the convicted person and the establishment of purposes at the time of criminal execution. Delimited the above, its modern concept, content and function will be presented. Finally, some general conclusions will be provided.
