GANGA CONTRERAS, Francisco y VALDIVIESO FERNANDEZ, Patricio. Role of the State in regards prison and human rights as cultural constructions. Polis [online]. 2015, vol.14, n.41, pp.395-421. ISSN 0718-6568. http://dx.doi.org/10.4067/S0718-65682015000200024.
Following a sad incident that took place at a chilean prison, emerges this work that aims primarily to reflect analytically about the role of the State and the connection of two cultural constructions, the prison system on the one hand and human rights on the other. The study reviews both constructs -in the context of the role the State has-, clearly establishing the cultural character of the same, but also stating their strong differences both in their origin, and in the enclaves that generated them, including the knowledge that related studies can gestate. The ethical speculations that surround the two technologies, involving prison and human rights, leads to the conclusion that the connection must be done in the effort of creating a decent society, rescuing the human subject from humiliation, the human subject that may represented in the abnormal.
