This article examines the concept and grounds of the criminal liability notion as a base for adequate characterization of the modifying circumstances of said liability; especially for proper understanding of its nature, its effects, and the values they stand on. The analysis also includes the consequences of the adoption by the Chilean Criminal Code of a specific regulation system, among which is the principle of obligation regarding the application of the circumstances.
