Resumen

MANALICH R, JUAN PABLO. OMISSION BY A GUARANTOR AND RESPONSIBILITY AS PRINCIPAL OR ACCESORY: A NORM-THEORETICAL RECONSTRUCTION. RDUCN [online]. 2014, vol.21, n.2, pp.225-276. ISSN 0718-9753.  http://dx.doi.org/10.4067/S0718-97532014000200007.

The article sets forward a certain understanding of the so called "improper omission offences", which leads to a clarification of the requirement of a guarantor position. This clarification enables an identification of a systematic ambiguity exhibited by the concept of a guarantor position, which rests upon the fact that the guarantor who omits a given action can also have responsibility as a principal or as an accessory to a commission offence. In order to disambiguate the concept of a guarantor position, the article offers a model built upon an integration of norm theory and action theory, whose performance is tested through its application to a wide series of cases. The case analysis gives a sufficiently vast sample of the different combinatory possibilities concerning the interrelation between the categories of omission by a guarantor and principal and accessory responsibility.

Palabras clave : Theory of norms; 'improper' omission offences; guarantor position; theory of action; principals and accessories.
