Abstract

AGUILAR CAVALLO, GONZALO. THE CHILEAN CONSTITUTIONAL COURT BEFORE THE JURISDICTION OF MILITARY COURTS. RDUCN [online]. 2015, vol.22, n.1, pp.23-63. ISSN 0718-9753.  http://dx.doi.org/10.4067/S0718-97532015000100002.

The recent case-law of the Constitutional Court has increasingly applied international human rights law, especially in the field of military justice in Chile. This paper seeks to analyze this case-law; to determine the scope of the application of the international human rights standards, and specifically, to determine to which extent the Court is undertaking a control of conventionality. In the light of this case-law, the author argues that the Constitutional Court is implicitly carrying out a control of conventionality of the domestic norms.

Keywords : Constitutional Court; military justice; International human rights law; case-law; control of conventionality.
