The civil liability of notaries and property registrars has been a matter hardly treated by national doctrine and jurisprudence, although these professionals intervene in a multiplicity of acts within the legal traffic -corporate law, real estate, inheritance, and so on- that are potentially likely to cause damages to those who require their services and even third parties, giving rise to claims for compensation. The purpose is to determine to which civil liability statute -contractual or delictual- these attestors are subject and in which cases the exception to the general rule of liability that is concluded must be applied. As a preliminary question the similarities between notaries and property registrars are analyzed, which justify a joint treatment of their liability regime.
