Extrajudicial settlement between the National Economic Prosecutor and market agents are analyzed. These settlements must be approved by the Court of Defence of Free Competition. The objective of this article is to demonstrate the nature of this mechanism to protect the free competition. This mech considered the elements that characterize this form of protection, especially, that there is no pronouncement on the substance of public law that consists of the action. As these are provisional measures, their content can be changed by going to the court that approved them anism is a manifestation of protective guardianship, and therefore all its effects must be.
